General Terms and Conditions for Hang Seng Credit Card and Hang Seng Affinity Card 2023 Year-round Discount Offers:
1. The offers are valid until 31 December 2023.
2. To enjoy the offers, customers are required to present Hang Seng Credit Card, Affinity Card or Spending Card before ordering / upon making reservation / upon purchase, and to settle payment with Hang Seng Credit Card, Affinity Card and Spending Card.
3. Selected Credit Card offers are only applicable to Selected Hang Seng Credit Card customers. Selected Hang Seng Credit Card includes: Hang Seng Visa Infinite Card, Prestige World Mastercard®, World Mastercard, The Hong Kong Jockey Club Membership Card (Platinum Mastercard and Gold Mastercard), The Racing Club Membership Card, Platinum Card, Prestige Banking Renminbi Platinum Card, Renminbi Platinum Card, Affinity Platinum Card, Affinity Platinum Spending Card, Commercial Card, UnionPay Renminbi Diamond Commercial Card, Business Card and any other Selected Hang Seng Credit Card issued by Hang Seng Bank Limited (“Hang Seng”).

7. The dining offers are not applicable to 10% service charge, charge for tea and condiments, takeaway services, set menu, regular-priced dishes/ special-priced items, private functions, banquets, private parties, catering services, tickets, ticket sales events and during happy hours (unless otherwise specified). Minimum consumption requirements of the respective merchants shall not include 10% service charge (unless otherwise specified). One dining offer can be used per table per patronage only.
8. The hotel accommodation offers are subject to 10% service charge (based on the original price), and are not applicable to function rooms, conference rooms and long-stay appointments (unless otherwise specified).
9. The dining and hotel accommodation offers are not applicable on public holidays and eves, festive days and eves, fireworks display nights, when tickets are required for entry to the relevant hotels/ restaurants and other dates as designated from time to time by the merchants (unless otherwise specified). 10. The offers are applicable to regular-priced items/ services only and are not applicable to fixed-priced, special-priced, consignment, promotional, festive and designated items/ services (unless otherwise specified).
11. The offers are not transferable, and cannot be redeemed or exchanged for cash, other products or discounts, and cannot be used in conjunction with other promotional offers, discounts, coupons, cash coupons, cake coupons or membership benefits/ VIP cards/ VIP bonus point programs of the merchants (unless otherwise specified).

19. No person other than the Customer and Hang Seng (which includes its successors and assigns) will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provision of these Terms and Conditions.
20. These Terms and Conditions are governed by and will be construed in accordance with the laws of the Hong Kong Special Administrative Region.
21. These Terms and Conditions are subject to prevailing regulatory requirements.
22. In case of any discrepancy between the English and Chinese versions of these terms and conditions, the English version shall prevail.

Remarks:

“Vouchers at Soundwill Plaza II – Midtown” - Terms and Conditions:
1. The Promotion is valid from 1st July, 2023 to 30th September, 2023, both dates inclusive) ("Promotion Period").
2. Only Soundwill Club members registered through mobile application are eligible to the Promotion. Download Soundwill Club App: https://www.midtown.com.hk/app/.
3. To be eligible for the Promotion, Cardholders are required to settle payment with BEA Credit Card ("Eligible Cards") within the Promotion Period at participating merchants (“Participating Merchants”) at Soundwill Plaza II – Midtown. The types of BEA Credit Card accepted may vary among the merchants. Please contact the relevant merchant for details.
4. Cardholders who spend with the following Eligible Card at merchants at Soundwill Plaza II – Midtown (“Eligible Transaction”) can redeem corresponding complimentary voucher (“Voucher”) in the following sums as below table on the same day of making the Eligible Transaction.

6. Eligible Transaction does NOT include split transaction, prepayment, deposit, cash advance, purchase or order made via mail, fax, phone or internet, purchase of any cash coupon, gift voucher, prepaid, add-value service, insurance, utilities payment, membership payments, any payment service, any unposted/ cancelled/ refunded/ unauthorized transactions and transaction without original credit card sales slips or printed merchant receipts.
7. Cardholders are required to register at the gift redemption concierge in person within the same date of the Eligible Transaction by presenting the original credit card sales slips and printed merchant receipts made at Soundwill Plaza and Soundwill Plaza II - Midtown for redemption. Cardholders will also be required to provide full credit card numbers, transaction amounts, transaction dates and approval codes for registration. The original credit card sales slip should indicate clearly the Eligible Cards card numbers, merchant names, transaction dates, transaction amounts, valid authorisation codes and signatures of Cardholders (if applicable). The first 6 and last 4 digits of BEA Credit Card number will be collected for internal audit once they have been submitted. Printed merchant receipts should state the merchant names, transaction dates, transaction amounts and sales items clearly. The transaction amounts in both credit card sales slips and printed merchant receipts must be the same. If Cardholders present insufficient information, Cardholders will not be entitled to enjoy any offer for whatever reason. The information collected will be destroyed 2 months after the Promotion.
8. The gift redemption concierge is located on G/F, Soundwill Plaza II - Midtown, Hong Kong Causeway Bay (Monday to Sunday and Public Holidays, 12noon to 10pm). Late redemption, handwritten, revised or copy sales slips and receipts will not be accepted. Each Eligible Transaction sales slip can only be used for redemption once.

15. Cardholders understand and accept that BEA is not the supplier of the products and/or services offered in this Promotion. BEA shall have no liability relating to any aspect of the products and/or services, including without limitation, their quality, the supply, the descriptions of goods and/or services provided by the merchants, any trade description, representation, statement, practices or conduct in connection with the Promotion or in making available the products and/or services in relation to the Promotion, by the merchants, their employees, officers or agents.
16. BEA reserves the right to decide the Eligible Transactions. Any matter or dispute will be subject to the final decision of BEA.
17. Cardholders are required to keep the original credit card sales slips and printed merchant receipts made at Soundwill Plaza II - Midtown for inspection. In case of disputes, Cardholders are required to present the relevant original credit card sales slips and printed merchant receipts for further investigation. All relevant documents submitted to BEA will not be returned.
18. No person other than the Cardholders, BEA and Soundwill Plaza ll – Midtown will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce or enjoy the benefit of any of the provisions of these Terms and Conditions.
19. BEA and Soundwill Plaza II - Midtown are neither vendors nor service providers, and as such neither BEA nor Soundwill Plaza ll - Midtown shall take any responsibility for the products or services provided by the participating merchants.
20. BEA and Soundwill Plaza II - Midtown reserve the sole right to vary or cancel the Offer and/or amend or alter these Terms and Conditions at any time with appropriate notice. In the event of any dispute, the decision of BEA and Soundwill Plaza II - Midtown shall be final and conclusive.
21. If there is any inconsistency or ambiguity between the English version and the Chinese version of these terms and conditions, the English version shall prevail.
